1. objective and responsible body

This data protection notice clarifies the type, scope and purpose of the processing (including collection, processing and use as well as obtaining consent) of personal data within our online offering and the websites, functions and content associated with it. The data protection notice applies regardless of the domains, systems, platforms and devices used (e.g. desktop or mobile) on which the online offering is executed.

Emil Scheibel distillery GmbH, Grüner Winkel 32, 77876 Kappelrodeck (hereinafter referred to as "provider", "we" or "us") as the operator of the website distillery (hereinafter referred to as "distillery") is responsible for the handling of the personal data of the users of distillery (hereinafter referred to as "you").

We have taken technical and organizational measures to ensure that both we and our service providers comply with data protection regulations.

2. processing of personal data

Personal data is information that can be used to find out your identity. This includes, for example, information such as your real name, postal address, e-mail address or telephone number. However, information collected with the help of cookies (see "Cookies") without direct reference to your identity, e.g. about how you use distillery , can also be personal data if this information is collected, stored and evaluated in a user-related and thus individualized manner via an assigned identifier. Information that is only collected and evaluated in aggregated form, i.e. combined into larger, non-individualized units, is not personal data.

3. collection of access data and purpose limitation

You can use our online offer on distillery largely without disclosing your identity. The information we collect from you as standard when you access distillery is provided under "Log data" and "Pseudonymous user profiles when visiting distillery ".

When you register for one of our personalized services (e.g. My Account) or order a product (e.g. in our online store), we ask you for your name and other personal information, see "Registration with distillery".

We use and process personal data that you provide to us for the purposes for which you have transmitted this data to us. For example, we use the information you provide via the contact form to process your request.

4. log data

When you access distillery , your Internet browser automatically transmits data (hereinafter referred to as "log data") to our web server for technical reasons, which we record in log files. This data includes the date of access, the time of access, the URL of the referring website, the file accessed, the volume of data transferred, the browser type and version, the operating system, the IP address and the domain name of your Internet access provider.

This is exclusively information that does not allow any conclusions to be drawn about your person. This information is technically necessary in order to correctly deliver the website content you have requested and is mandatory when using Internet services. The log data is evaluated purely for statistical purposes in order to optimize our website and the technology behind it and is then deleted.

The log data is stored separately from other data collected in the course of using distillery (see "Disclosure of data to third parties").

5. collection and processing when using the contact form

When using the contact form, we collect your personal data (name, e-mail address, message text, telephone number if applicable) only to the extent provided by you. The data processing serves the purpose of establishing contact. By sending your message, you consent to the processing of the transmitted data. The processing is carried out on the basis of Art. 6 (1) lit. a GDPR with your consent. You can revoke your consent at any time by notifying us without affecting the legality of the processing carried out on the basis of the consent until revocation. We will only use your email address to process your request. Your data will then be deleted unless you have consented to further processing and use.

CleanTalk anti-spam check

We use the "CleanTalk" service, which protects the website from spam. It is used on the basis of our legitimate interests within the meaning of Article 6(1)(f) of the General Data Protection Regulation (GDPR).

For security reasons and to protect against spam, your data is processed in the CleanTalk Cloud Service and stored in log files for a maximum of 45 days. At the end of this period, this data will be completely deleted. CleanTalk may use information about the spam activity of IP or email addresses to provide adequate anti-spam protection to all websites connected to its service.

Further information on the collection and use of data by CleanTalk can be found in the CleanTalk Inc. privacy policy: https://cleantalk.org/publicoffer#privacy

6. pseudonymous user profiles when visiting distillery

For the purposes of advertising, market research and the needs-based design of distillery (and the newsletter), we use cookies and/or JavaScript to collect usage data about your website visit and the use of links in the newsletter. The collection of your usage data and the creation of a usage profile is pseudonymized using a cookie ID.

Cookies are stored on the user's computer when the website is used. Cookies are small text files that are stored on the user's hard disk and assigned to the browser used by the user and through which certain information flows to the body that sets the cookie (in this case us). Cookies cannot execute programs or transmit viruses to the user's computer.

They are used to make the website more user-friendly and effective overall. We use cookies to identify the user for subsequent visits if the user has an account with us. Otherwise, the user would have to log in again for each visit.

We create and store these usage profiles exclusively in pseudonymous form and do not combine them with your name or other information that reveals your identity, such as your e-mail address.

We use Google Analytics, a web analytics service provided by Google Inc, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA ("Google"). The data is processed in the USA, a country outside the scope of Directive 95/46/EC of the European Parliament and of the Council of October 24, 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (OJ EC No. L 281 p. 31). Google uses cookies. The information generated by the cookie about the use of the online offer by the user is usually transmitted to a Google server in the USA and stored there.

Google will use this information on our behalf to evaluate the use of our online offer by users, to compile reports on the activities within this online offer and to provide us with further services associated with the use of this online offer and the use of the Internet. Pseudonymous user profiles can be created from the processed data.

We only use Google Analytics with activated IP anonymization. This means that the IP address of the user is shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there.

The IP address transmitted by the user's browser will not be merged with other Google data. Users can prevent the storage of cookies by setting their browser software accordingly (opt-out); users can also prevent the collection of data generated by the cookie and related to their use of the online offer to Google and the processing of this data by Google by downloading and installing the browser plug-in available at the following link: http://tools.google.com/dlpage/gaoptout?hl=de.

You can find more information on the use of data for advertising purposes by Google, setting and objection options on the Google websites: https://www.google.com/intl/de/policies/privacy/partners ("Data use by Google when you use our partners' websites or apps"), http://www.google.com/policies/technologies/ads ("Data use for advertising purposes"), http://www.google.de/settings/ads ("Manage information that Google uses to show you advertising") and http://www.google.com/ads/preferences ("Determine which advertising Google shows you").

We use the Google Remarketing service of Google Inc. 1600 Amphitheatre Parkway Mountain View, CA 94043, USA ("Google"). The data is processed in the USA, a country outside the scope of Directive 95/46/EC of the European Parliament and of the Council of October 24, 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (OJ EC No. L 281 p. 31). Through this service, if you have already visited our websites and online services and are interested in the offer, you will be addressed again through targeted advertising on the pages of the Google Partner Network. Advertising is displayed through the use of cookies. With the help of text files, your user behavior when visiting the website can be analyzed and then used for targeted product recommendations and interest-based advertising.

If you wish to object to the collection by Google marketing services, you can use the setting and opt-out options provided by Google: http://www.google.com/ads/preferences.

7. meta pixel

Our website uses the Facebook/Meta visitor action pixel, provided by Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland, to measure conversions. According to Facebook, the data collected is also transferred to the USA and other third countries.

This pixel can be used to track the behavior of site visitors after they have been redirected to our website by clicking on a Facebook ad. This enables us to evaluate the effectiveness of Facebook ads for statistical and market research purposes and to optimize future advertising measures.

The data collected is anonymous to us, so we cannot draw any conclusions about the identity of the user. However, Facebook stores and processes the data so that a connection to the respective user profile is possible and Facebook can use the data for its own advertising purposes in accordance with the Facebook Data Usage Policy(https://de-de.facebook.com/about/privacy/). This enables Facebook to place advertisements on Facebook and outside of Facebook. We cannot influence this use of the data.

The use of this service is based on your consent in accordance with Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TTDSG. You can withdraw your consent at any time.

Extended adjustment

We use the advanced matching function within the meta pixel. This enables us to transmit various types of data (e.g. place of residence, federal state, zip code, hashed email addresses, name, gender, date of birth or telephone number) of our customers and interested parties to Meta (Facebook). This allows us to tailor our advertising campaigns on Facebook more precisely to people who are interested in our offers. The extended matching also improves the allocation of website conversions and expands Custom Audiences.

Insofar as personal data is collected with this tool and forwarded to Facebook, we and Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland, are jointly responsible for this data processing (Art. 26 GDPR). The responsibility is limited to the collection and forwarding of data to Facebook. Processing by Facebook is not part of the joint responsibility. The obligations incumbent on us have been set out in a joint processing agreement, which you can view here: https://www.facebook.com/legal/controller_addendum. In this agreement, we are responsible for the provision of data protection information and the secure implementation of the tool on our website in accordance with data protection law. Facebook is responsible for the data security of Facebook products. You can assert data subject rights (e.g. requests for information) regarding the data processed by Facebook directly with Facebook. If you assert data subject rights with us, we will forward them to Facebook.

Data is transferred to the USA on the basis of the EU Commission's standard contractual clauses. Details can be found here: https://www.facebook.com/legal/EU_data_transfer_addendum and https://de-de.facebook.com/help/566994660333381.

You can find further information on protecting your privacy in Facebook's privacy policy: https://de-de.facebook.com/about/privacy/.

You can deactivate the remarketing function "Custom Audiences" in the settings for advertisements at https://www.facebook.com/ads/preferences/?entry_product=ad_settings_screen. You must be logged in to Facebook to do this.

If you do not have a Facebook account, you can deactivate usage-based advertising from Facebook on the website of the European Interactive Digital Advertising Alliance: http://www.youronlinechoices.com/de/praferenzmanagement/.

Meta is certified according to the "EU-US Data Privacy Framework" (DPF), which is intended to ensure compliance with European data protection standards for data processing in the USA. Further information can be found here: https://www.dataprivacyframework.gov/s/participant-search/participant-detail?contact=true&id=a2zt0000000GnywAAC&status=Active.

8. disclosure of data to third parties

We work together with various service providers to realize the distillery website. Insofar as we have obliged these service providers to process data strictly in accordance with our instructions as commissioned data processors pursuant to Section 11 of the German Federal Data Protection Act (BDSG), data processing by these external parties does not require your consent.

In other cases, insofar as your consent is required for the transfer of personal data of users of the distillery website to service providers for data protection reasons, we will inform you separately and will not transfer your data without your prior consent. If you have given your consent, you may withdraw it at any time without affecting the lawfulness of processing based on consent before its withdrawal.

13th Newsletter

The following information explains the content of our newsletter as well as the registration, dispatch and statistical evaluation procedure and your rights of objection. By subscribing to our newsletter, you agree to receive it and to the procedures described.

Content of the newsletter: We only send newsletters, emails and other electronic notifications with advertising information (hereinafter "newsletter") with the consent of the recipient or legal permission. If the contents of the newsletter are specifically described when registering for the newsletter, they are decisive for the user's consent. Our newsletters also contain the following information: Information about our products, offers, new products, recipes, gourmet tips.

Double opt-in and logging: Registration for our newsletter takes place in a so-called double opt-in procedure. This means that after registering you will receive an e-mail asking you to confirm your registration. This confirmation is necessary so that no-one can register with other people's e-mail addresses. Subscriptions to the newsletter are logged in order to be able to prove the registration process in accordance with legal requirements. This includes storing the time of registration and confirmation as well as the IP address. Changes to your data stored by the mailing service provider are also logged.

Dispatch service provider: The newsletter is sent by "CleverReach" (hereinafter referred to as the "dispatch service provider"). You can view the data protection provisions of the dispatch service provider here: https://www.cleverreach.com/de/datensicherheit/

The email addresses of our newsletter recipients, as well as their other data described in this notice, are stored on the servers of the mailing service provider. The mailing service provider uses this information to send and evaluate the newsletter on our behalf. Furthermore, the mailing service provider may, according to its own information, use this data to optimize or improve its own services, e.g. for the technical optimization of the mailing and the presentation of the newsletter or for economic purposes in order to determine from which countries the recipients come. However, the mailing service provider does not use the data of our newsletter recipients to write to them itself or pass it on to third parties.

Registration data: To register for the newsletter, it is sufficient to enter your e-mail address. Optionally, we ask you to provide the following data: First and last name to personalize the newsletter, date of birth to verify that you are of legal age.

The data will be used exclusively for sending the newsletter and will not be passed on to third parties.

Statistical survey and analyses - The newsletters contain a so-called "web-beacon", i.e. a pixel-sized file that is retrieved from the server of the mailing service provider when the newsletter is opened. As part of this retrieval, technical information, such as information about the browser and your system, as well as your IP address and time of retrieval, is initially collected. This information is used for the technical improvement of the services based on the technical data or the target groups and their reading behavior based on their retrieval locations (which can be determined with the help of the IP address) or the access times. The statistical surveys also include determining whether the newsletters are opened, when they are opened and which links are clicked. For technical reasons, this information can be assigned to individual newsletter recipients. However, it is neither our intention nor that of the mailing service provider to observe individual users. The evaluations serve us much more to recognize the reading habits of our users and to adapt our content to them or to send different content according to the interests of our users.

We use the Google service reCaptcha to determine whether a human or a computer is making a certain entry in our contact or newsletter form. Google uses the following data to check whether you are a human or a computer IP address of the end device used, the website that you visit on our site and on which the captcha is integrated, the date and duration of the visit, the identification data of the browser and operating system type used, Google account if you are logged in to Google, mouse movements on the reCaptcha areas and tasks in which you have to identify images. The legal basis for the data processing described is Art. 6 para. 1 lit. f GDPR. We have a legitimate interest in this data processing to ensure the security of our website and to protect us from automated entries (attacks).

Cancellation/revocation - You can cancel the receipt of our newsletter at any time, i.e. revoke your consent. At the same time, your consent to its dispatch by the dispatch service provider and the statistical analyses will expire. Unfortunately, it is not possible to withdraw your consent to the newsletter being sent by the newsletter service provider or to the statistical analysis separately. You will find a link to unsubscribe from the newsletter at the end of each newsletter.

14. data of minors

Persons under the age of majority should not transmit any personal data to us without the consent of their parents or legal guardians.

15. links to other websites

Our online offer contains links to other websites. We have no influence on whether their operators comply with data protection regulations.

The integration of content from third-party providers always requires that the third-party providers are aware of the user's IP address, as they would not be able to send the content to the user's browser without the IP address. The IP address is therefore required to display this content. Furthermore, the providers of third-party content can set their own cookies and process the user's data for their own purposes. User profiles can be created from the processed data. We will use this content as sparingly as possible and in a data-avoiding manner and select reliable third-party providers with regard to data security.

The following presentation provides an overview of third-party providers and their content, together with links to their data protection notices, which contain further information on the processing of data and, in some cases already mentioned here, opt-out options:

16. right to information as well as correction, deletion and blocking of data

If you have any questions about data protection or requests to correct, block, transfer or delete your personal data, please contact us directly using the contact details provided in the legal notice.

Users have the right, upon request and free of charge, to receive information about the personal data that we have stored about them.

In addition, users have the right to correct incorrect data, revoke consent, block, transfer and delete their personal data as well as the right to lodge a complaint with the competent supervisory authority in the event of the assumption of unlawful data processing.

The data stored by us will be deleted as soon as it is no longer required for its intended purpose and the deletion does not conflict with any statutory retention obligations.

17. amendment of our data protection provisions

We reserve the right to change the data protection notice in order to adapt it to changed legal situations or in the event of changes to the service and data processing. However, this only applies with regard to information on data processing. If user consent is required or parts of the data protection notice contain provisions of the contractual relationship with the users, the changes will only be made with the consent of the users.
Users are requested to inform themselves regularly about the content of the data protection information.
